GENERAL TERMS OF BUSINESS<\/p>\n

Please read these General Terms of Use carefully before using the website www.personaliziranelampe.hr to purchase products or obtain information about specific products.<\/p>\n

The holder of all rights to the website www.personaliziranelampe.hr is PERLA, a craft business for production, trade, and specialized activities, owned by Mirjana Lon\u010dar, Privlaka, Josipa Juraja Strossmayera 6, VAT ID: 30973038978, Company ID: 98833707, Email: perla@personaliziranelampe.hr (hereinafter: PERLA), which provides the service of sales through its service \u2013 Web shop (hereinafter: Web shop).<\/p>\n

By using the Web shop and all associated pages and services on the domain www.personaliziranelampe.hr, consumers are considered to be acquainted with these Sales Terms (hereinafter: Terms) at all times and to fully understand and accept them. These Terms apply to the rights and obligations related to purchasing products through the Web shop and the rights and obligations arising from the conclusion of a Distance Sales Contract (hereinafter: Contract) between the consumer as the end customer and the Web shop.<\/p>\n

The provider of the internet sales service through the Web shop is PERLA.<\/p>\n

A customer is any legal or natural person who places an order and makes payment through the online store (www.personaliziranelampe.hr).<\/p>\n

All content on the Web Shop PERLA website and General Terms are subject to changes by the Seller, and Users are advised to familiarize themselves with these Terms before making a purchase and to check them regularly to stay informed about all user rights and obligations. The Seller is not responsible for any consequences of the User or Buyer\u2019s failure to do so.<\/p>\n

PERLA reserves the right to change these Terms at any time without prior notice and will not be responsible for any consequences arising from such changes. Changes take effect upon publication on these websites.<\/p>\n

These General Terms of Online Purchase regulate the relationship between Users or Buyers of the PERLA Web Shop and the Seller regarding the use of the web shop, ordering products, payment and production of products, delivery of products, receipt of products, complaints and returns, contract duration, confidentiality of personal data, and other matters related to the use of the Web Shop and online purchase, all in accordance with applicable regulations, primarily the Trade Act, the Electronic Commerce Act, the Consumer Protection Act, and the Obligations Act.<\/p>\n

  1. PURCHASE TERMS<\/strong><\/li>\n<\/ol>\n

    The supplier of the ordered goods is PERLA, which enables the purchase of its products via the Internet store to the customer's delivery address.<\/p>\n

    The customer is a natural or legal person who orders a product and pays for the delivery service through the Web shop.<\/p>\n

    Products are delivered at the prices valid on the day of ordering, and all prices are expressed in EUR (VAT is included in the price). Prices, payment terms, and promotional offers are valid only at the time of ordering and may change without prior notice.<\/p>\n

    PERLA reserves the right not to deliver an order if there is suspicion of misuse.<\/p>\n

    1.1. Use of the Web Shop Service<\/strong><\/p>\n

    The customer is responsible for the accuracy and completeness of the data entered during registration and purchase.
    If any changes occur in the data you entered during the purchase, please notify us as soon as possible via email: perla@personaliziranelampe.hr.<\/p>\n

    1.2. Ordering Products<\/strong><\/p>\n

    Products are ordered electronically, and ordering through the online store is possible 24 hours a day, 7 days a week.
    By pressing the \"Add to Cart\" button, the selected product is added to the shopping cart. Products are considered ordered when the customer completes the entire \"Checkout\" process.<\/p>\n

    1.3. Payment and Production of Products<\/strong><\/p>\n

    Since products are made according to the customer's specific requirements, during the order, the customer selects all key items for product production, and by placing the order, confirms that the product is clearly tailored to the customer's wishes and needs, thus waiving the right to unilateral contract termination by the customer.<\/p>\n

    The invoice that the customer will receive by email represents confirmation of the concluded contract. We issue invoices electronically to the email address provided at the time of order.
    If you require a physical invoice, please mention it in the note or contact us to have it delivered with the order.<\/p>\n

    The customer agrees to pay for the ordered products to PERLA, and payment on the PERLA Web shop can be made via bank transfer, i.e., payment to the craft\u2019s account.<\/p>\n

    After completing the purchase with the \"Bank Transfer\" option, you will receive payment details via email. The invoice can be paid via internet banking or general payment at a bank, post office, or FINA.<\/p>\n

    Upon receipt of funds in our business account, the product(s) will be manufactured according to the customer's specification, and production requires 7-14 days. If the customer needs the product before this period, please contact us to see if we can make an exception at that time.<\/p>\n

    If a product cannot be manufactured for any reason, the customer will be informed and offered a similar replacement product or a refund.<\/p>\n

    1.4. Product Delivery<\/strong><\/p>\n

    Isporuka paketa vr\u0161i se dostavom na adresu, putem\u00a0 kurirske slu\u017ebe MBE – Mail Boxes Etc. Dostavna slu\u017eba prikuplja narud\u017ebe na dnevnoj bazi te ih vlastitim dostavnim vozilima svaki radni dan dostavlja na adrese kupaca. PERLA se ne mo\u017ee smatrati odgovornim zbog ka\u0161njenja u dostavi prouzrokovanih dostavnom slu\u017ebom ili \u201cvi\u0161om silom\u201d.<\/p>\n

    Delivery is made within Croatia and to all EU member countries: Austria, Belgium, Bulgaria, Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Germany, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden.<\/p>\n

    The usual delivery time for products within Croatia is 2-5 business days, although most shipments are delivered the next day.<\/p>\n

    Delivery to countries outside Croatia can take up to 20 business days, typically within 5 to 10 business days.<\/p>\n

    The delivery price for EU member countries is charged based on the country to which the package is sent.
    After filling in the delivery information, the price for the requested country will be displayed before payment.<\/p>\n

    Delivery speed may vary during holidays, non-working days, large sales events, and other situations where delivery difficulties may occur.<\/p>\n

    If you require delivery on a specific date, please indicate this in the order note or contact us directly with the note.<\/p>\n

    1.5. Package Receipt<\/strong><\/p>\n

    Products will be packaged to avoid damage during normal handling in transport. This does not mean that the package cannot be damaged during transport. Therefore, the customer or the person authorized by the customer to receive the package must check for any EXTERNAL damage to the package and immediately report it to the courier or photograph and refuse to accept such a package.<\/p>\n

    In this case, please contact us as soon as possible so we can promptly check the condition of the shipment and arrange further action for the related order or shipment.<\/p>\n

    After signing for receipt of the package, the customer or the person authorized to receive the package confirms that the product had no visible external defects.<\/p>\n

    1.6. Product Complaints<\/strong><\/p>\n

    Since each product (lamp) is made individually according to the order and consumer specification, the right to unilateral contract termination is lost, and returns are not possible (Consumer Protection Act, Article 86).<\/p>\n

    Due to the production process, lamps may have minor imperfections, but we always strive to minimize such imperfections. If minor imperfections do not affect the quality and functionality of the product, they are not recognized as product defects.<\/p>\n

    In the case of damage during delivery, incorrect delivery of goods, or if the received product is defective\/damaged, please contact us by email at perla@personaliziranelampe.hr within two business days of receiving the shipment.<\/p>\n

    All complaints will be resolved as quickly as possible. In these cases, PERLA covers all costs of replacing the product.\u00a0<\/p>\n

Kori\u0161tenjem usluge Web shopa i svih pridru\u017eenih stranica i servisa na domeni\u00a0www.personaliziranelampe.hr\u00a0smatra se da su potro\u0161a\u010di u svakom trenutku upoznati s ovim Uvjetima prodaje (dalje u tekstu: Uvjeti), te da ih u cijelosti razumiju i prihva\u0107aju. Ovi Uvjeti primjenjuju se na prava i obveze koja se odnose na kupnju proizvoda putem Web shopa te prava i obveze koje proizlaze iz sklapanja Ugovora o prodaji na daljinu (dalje u tekstu: Ugovor) izme\u0111u potro\u0161a\u010da kao krajnjeg kupca i Web shopa. Pru\u017eatelj usluge internet prodaje putem Web shopa je PERLA. Kupac je svaka pravna i fizi\u010dka osoba koja izvr\u0161i narud\u017ebu i pla\u0107anje putem internet trgovine\u00a0(www.personaliziranelampe.hr). Sav sadr\u017eaj stranice Web Shop PERLA kao i Op\u0107i uvjeti podlo\u017eni su izmjenama od strane Prodavatelja te Korisnike upu\u0107ujemo da se prije kupnje upoznaju s ovim Uvjetima te da iste redovito provjeravaju, kako bi bili upoznati sa svim korisni\u010dkim pravima i obvezama. Prodavatelj ne snosi nikakvu odgovornost zbog propu\u0161tanja Korisnika odnosno Kupca da to u\u010dini. PERLA pridr\u017eava pravo izmjene ovih Uvjeta u svako doba bez obaveze prethodne najave te ne\u0107e biti odgovoran ni za kakve mogu\u0107e posljedice proiza\u0161le iz takvih promjena. Navedene promjene stupaju na snagu objavljivanjem na ovim internet stranicama. Ovim Op\u0107im uvjetima online kupovine ure\u0111uju se odnosi izme\u0111u Korisnika, odnosno Kupaca Web Shop-a\u00a0PERLA\u00a0i Prodavatelja, a u odnosu na uvjete i na\u010din kori\u0161tenja web shopa, naru\u010divanja proizvoda, pla\u0107anja i izrade proizvoda, dostave proizvoda, preuzimanja proizvoda, reklamacije i povrata proizvoda, trajanja ugovora, tajnosti osobnih podataka i druga pitanja vezana uz kori\u0161tenje Web Shop-a i online kupnju, sve u skladu s va\u017ee\u0107im propisima, prvenstveno\u00a0Zakonom o trgovini, Zakonom o elektroni\u010dkoj trgovini, Zakonom o za\u0161titi potro\u0161a\u010da i Zakonom o obveznim odnosima. UVJETI KUPNJE Isporu\u010ditelj naru\u010dene robe je PERLA, koji putem Internet trgovine omogu\u0107uje kupnju svojih proizvoda, a prema adresi dostave kupca. Kupac je fizi\u010dka ili pravna osoba koja naru\u010duje proizvod i pla\u0107a uslugu dostave proizvoda\u00a0Prodavatelju, posredstvom Web shopa. Proizvodi se isporu\u010duju po cijenama va\u017ee\u0107im na dan naru\u010divanja, a sve cijene se izra\u017eene u valuti EUR (PDV je ura\u010dunat u cijenu). Cijene, uvjeti pla\u0107anja i akcijske ponude vrijede isklju\u010divo u trenutku narud\u017ebe i mogu se promijeniti bez prethodne najave. PERLA zadr\u017eava pravo ne isporuke narud\u017ebe ukoliko postoji sumnja na zlouporabu. 1.1. Kori\u0161tenje usluge web shopa Kupac snosi odgovornost za to\u010dnost i potpunost unesenih podataka prilikom registracije i kupnje.Ukoliko do\u0111e do bilo kakve promjene podataka koje ste unijeli prilikom kupnje, molimo Vas da nas u \u010dim skorijem roku obavijestite o nastalim promjenama putem e-mail adrese:\u00a0perla@personaliziranelampe.hr 1.2. Naru\u010divanje proizvoda Proizvodi se naru\u010duju elektroni\u010dkim putem, a naru\u010divanje robe putem internetske trgovine mogu\u0107e je 24 sata na dan, 7 dana u tjednu. Pritiskom gumba \u201eU ko\u0161aricu\u201c, odabrani proizvod se dodaje u potro\u0161a\u010dku ko\u0161aricu. Proizvodi se smatraju naru\u010denim u trenutku kada kupac pro\u0111e cijeli proces \u201eNaplate\u201c. 1.3. Pla\u0107anje i izrada proizvoda Obzirom da proizvode izra\u0111ujemo prema specifi\u010dnim zahtjevima kupca, prilikom narud\u017ebe, kupac odabire sve stavke klju\u010dne za izradu proizvoda, a narud\u017ebom potvr\u0111uje da je proizvod jasno prilago\u0111en \u017eeljama i potrebama Kupca te se po tom osnovu gubi pravo na jednostrani raskid ugovora od strane kupca. Ra\u010dun koji \u0107e kupac primiti e-mailom predstavlja potvrdu o sklopljenom ugovoru. Ra\u010dun izdajemo elektronskim putem na e-mail adresu navedenu prilikom izvr\u0161avanja narud\u017ebe.Ukoliko \u017eelite fizi\u010dki ra\u010dun, potrebno je to naglasiti u napomeni ili nas kontaktirati kako bi isti dostavili zajedno s narud\u017ebom. Kupac se obvezuje naru\u010dene proizvode platiti PERLI, a pla\u0107anje na PERLA Web shop-u mogu\u0107e je bankovnom transakcijom, tj. uplatom na ra\u010dun obrta. Po zavr\u0161etku kupnje s odabirom \u201eBankovna transakcija\u201c, na navedeni e-mail dobit \u0107ete podatke o pla\u0107anju. Ra\u010dun se mo\u017ee platiti internet bankarstvom ili op\u0107om uplatom u banci, po\u0161ti ili FINA-i. Po primitku sredstava na na\u0161 poslovni ra\u010dun, proizvod\/i \u0107e biti izra\u0111en\/i prema specifikaciji Kupca, a za izradu proizvoda potrebno nam je 7-14 dana. U slu\u010daju da je Kupcu proizvod potreban prije navedenog roka, slobodno nas kontaktirajte kako bi utvrdili mo\u017eemo li u tome trenutku napraviti iznimku. Ako se odre\u0111eni proizvod iz nekog razloga ne mo\u017ee izraditi, Kupac \u0107e biti obavije\u0161ten te \u0107e mu biti ponu\u0111en najsli\u010dniji zamjenski proizvod ili povrat novaca. 1.4.\u00a0Dostava proizvoda Isporuka paketa vr\u0161i se dostavom na adresu, putem\u00a0 kurirske slu\u017ebe MBE – Mail Boxes Etc. Dostava u zemlje izvan Hrvatske mo\u017ee potrajati i do 20 radnih dana, a u pravilu do 5 do 10 radnih dana.
