GENERAL TERMS OF BUSINESS
Please read these General Terms of Use carefully before using the website www.personaliziranelampe.hr to purchase products or obtain information about specific products.
The holder of all rights to the website www.personaliziranelampe.hr is PERLA, a craft business for production, trade, and specialized activities, owned by Mirjana Lončar, Privlaka, Josipa Juraja Strossmayera 6, VAT ID: 30973038978, Company ID: 98833707, Email: perla@personaliziranelampe.hr (hereinafter: PERLA), which provides the service of sales through its service – Web shop (hereinafter: Web shop).
By using the Web shop and all associated pages and services on the domain www.personaliziranelampe.hr, consumers are considered to be acquainted with these Sales Terms (hereinafter: Terms) at all times and to fully understand and accept them. These Terms apply to the rights and obligations related to purchasing products through the Web shop and the rights and obligations arising from the conclusion of a Distance Sales Contract (hereinafter: Contract) between the consumer as the end customer and the Web shop.
The provider of the internet sales service through the Web shop is PERLA.
A customer is any legal or natural person who places an order and makes payment through the online store (www.personaliziranelampe.hr).
All content on the Web Shop PERLA website and General Terms are subject to changes by the Seller, and Users are advised to familiarize themselves with these Terms before making a purchase and to check them regularly to stay informed about all user rights and obligations. The Seller is not responsible for any consequences of the User or Buyer’s failure to do so.
PERLA reserves the right to change these Terms at any time without prior notice and will not be responsible for any consequences arising from such changes. Changes take effect upon publication on these websites.
These General Terms of Online Purchase regulate the relationship between Users or Buyers of the PERLA Web Shop and the Seller regarding the use of the web shop, ordering products, payment and production of products, delivery of products, receipt of products, complaints and returns, contract duration, confidentiality of personal data, and other matters related to the use of the Web Shop and online purchase, all in accordance with applicable regulations, primarily the Trade Act, the Electronic Commerce Act, the Consumer Protection Act, and the Obligations Act.
- PURCHASE TERMS
The supplier of the ordered goods is PERLA, which enables the purchase of its products via the Internet store to the customer's delivery address.
The customer is a natural or legal person who orders a product and pays for the delivery service through the Web shop.
Products are delivered at the prices valid on the day of ordering, and all prices are expressed in EUR (VAT is included in the price). Prices, payment terms, and promotional offers are valid only at the time of ordering and may change without prior notice.
PERLA reserves the right not to deliver an order if there is suspicion of misuse.
1.1. Use of the Web Shop Service
The customer is responsible for the accuracy and completeness of the data entered during registration and purchase.
If any changes occur in the data you entered during the purchase, please notify us as soon as possible via email: perla@personaliziranelampe.hr.
1.2. Ordering Products
Products are ordered electronically, and ordering through the online store is possible 24 hours a day, 7 days a week.
By pressing the "Add to Cart" button, the selected product is added to the shopping cart. Products are considered ordered when the customer completes the entire "Checkout" process.
1.3. Payment and Production of Products
Since products are made according to the customer's specific requirements, during the order, the customer selects all key items for product production, and by placing the order, confirms that the product is clearly tailored to the customer's wishes and needs, thus waiving the right to unilateral contract termination by the customer.
The invoice that the customer will receive by email represents confirmation of the concluded contract. We issue invoices electronically to the email address provided at the time of order.
If you require a physical invoice, please mention it in the note or contact us to have it delivered with the order.
The customer agrees to pay for the ordered products to PERLA, and payment on the PERLA Web shop can be made via bank transfer, i.e., payment to the craft’s account.
After completing the purchase with the "Bank Transfer" option, you will receive payment details via email. The invoice can be paid via internet banking or general payment at a bank, post office, or FINA.
Upon receipt of funds in our business account, the product(s) will be manufactured according to the customer's specification, and production requires 7-14 days. If the customer needs the product before this period, please contact us to see if we can make an exception at that time.
If a product cannot be manufactured for any reason, the customer will be informed and offered a similar replacement product or a refund.
1.4. Product Delivery
Packages are delivered to the address via GLS or Overseas Express courier services for domestic delivery, and for international delivery, via MBE – Mail Boxes Etc. courier service. The courier service collects orders daily and delivers them to customers' addresses every business day. PERLA cannot be held responsible for delays caused by the courier service or "force majeure."
Delivery is made within Croatia and to all EU member countries: Austria, Belgium, Bulgaria, Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Germany, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden.
The usual delivery time for products within Croatia is 2-5 business days, although most shipments are delivered the next day.
Customers have the option to choose the courier service for package delivery at checkout. The cost of delivery via Overseas Express is included in the price for Croatia, while delivery via GLS incurs an additional charge, and the price will be displayed during the checkout process.
Delivery to countries outside Croatia can take up to 20 business days, typically within 5 to 10 business days.
The delivery price for EU member countries is charged based on the country to which the package is sent.
After filling in the delivery information, the price for the requested country will be displayed before payment.
Delivery speed may vary during holidays, non-working days, large sales events, and other situations where delivery difficulties may occur.
If you require delivery on a specific date, please indicate this in the order note or contact us directly with the note.
1.5. Package Receipt
Products will be packaged to avoid damage during normal handling in transport. This does not mean that the package cannot be damaged during transport. Therefore, the customer or the person authorized by the customer to receive the package must check for any EXTERNAL damage to the package and immediately report it to the courier or photograph and refuse to accept such a package.
In this case, please contact us as soon as possible so we can promptly check the condition of the shipment and arrange further action for the related order or shipment.
After signing for receipt of the package, the customer or the person authorized to receive the package confirms that the product had no visible external defects.
1.6. Product Complaints
Since each product (lamp) is made individually according to the order and consumer specification, the right to unilateral contract termination is lost, and returns are not possible (Consumer Protection Act, Article 86).
Due to the production process, lamps may have minor imperfections, but we always strive to minimize such imperfections. If minor imperfections do not affect the quality and functionality of the product, they are not recognized as product defects.
In the case of damage during delivery, incorrect delivery of goods, or if the received product is defective/damaged, please contact us by email at perla@personaliziranelampe.hr within two business days of receiving the shipment.
All complaints will be resolved as quickly as possible. In these cases, PERLA covers all costs of replacing the product.
